A central concept in Dutch health law is the care of a good caregiver. We find this standard in various statutes and in legal doctrine. This concept is, however, vague and open and must be made more concrete in professional practice, in moral theory, and in law. In this article, we explore the implications of this complex standard and analyze what moral philosophy and jurisprudence can contribute to its clarification and implementation in professional practice and law. Regenerative Medicine promises to develop treatments to regrow healthy tissues and cure the physical body. One of the emerging developments within this field is regenerative implants, such as jawbone or heart valve implants, that can be broken down by the body and are gradually replaced with living tissue. Yet challenges for embodiment are to be expected, given that the implants are designed to integrate deeply into the tissue of the living body, so that implant and body become one. In this (...) paper, we explore how regenerative implants may affect the embodied experience of implant recipients. To this end, we take a phenomenological approach. First, we explore what insights the existing phenomenological and empirical literature on embodiment offers regarding the experience of illness and of living with regular (non-regenerative) implants and organ transplants. Second, we apply these insights to better understand how future implant recipients might experience living with regenerative implants. Third, we conclude that concepts and considerations from the existing phenomenological literature do not sufficiently address what it might be like to live with an implantable technology that, over time, becomes one with the living body. We argue that the interwovenness and intimate relationship of people living with regenerative implants should be understood in terms of ‘entanglement’. Entanglement allows us to explore the complexities of human-technology relations, acknowledging the inseparability of humans and implantable technologies. Our theoretical foundations regarding the role of embodiment may be tested empirically once more people will be living with regenerative implants. (shrink)

It may soon become possible not just to replace, but to re-grow healthy tissues after injury or disease, because of innovations in the field of Regenerative Medicine. One particularly promising innovation is a regenerative valve implant to treat people with heart valve disease. These implants are fabricated from so-called ‘smart’, ‘lifelike’ materials. Implanted inside a heart, these implants stimulate re-growth of a healthy, living heart valve. While the technological development advances, the ethical implications of this new technology are still unclear (...) and a clear conceptual understanding of the notions ‘smart' and ‘lifelike' is currently lacking. In this paper, we explore the conceptual and ethical implications of the development of smart lifelike materials for the design of regenerative implants, by analysing heart valve implants as a showcase. In our conceptual analysis, we show that the materials are considered ‘smart’ because they can communicate with human tissues, and ‘lifelike’ because they are structurally similar to these tissues. This shows that regenerative valve implants become intimately integrated in the living tissues of the human body. As such, they manifest the ontological entanglement of body and technology. In our ethical analysis, we argue this is ethically significant in at least two ways: It exacerbates the irreversibility of the implantation procedure, and it might affect the embodied experience of the implant recipient. With our conceptual and ethical analysis, we aim to contribute to responsible development of smart lifelike materials and regenerative implants. (shrink)

Al revisar la hermenéutica gadameriana de la programación y la interpretación musical, incluida la improvisación y el desafío de la nueva música, las reflexiones de Gadamer sobre la cultura musical en el contexto de la cultura social y su reflexión no solo pueden ser leídas a través de Platón y Goethe, sino también a partir de las concepciones de "lo bello" en Hölderlin y Rilke. Situating this discussion via Goethe and Plato along with Adorno’s late 1950s lectures on Aesthetics together with a discussion of Nietzsche and antiquity, what is at stake is attunement and a tension which invites a discussion of Carson on the lover’s arrest and Heidegger on tarrying. By reviewing Gadamer’s hermeneutic of musical pro-gramming and performance, including improvisation and the challenge of new music, Gadamer may be read on music culture in the context of social culture and his reflection not only via Plato and Goethe but Hölderlin and Rilke on ‘the beautiful.’ At work is a cultural ‘conversation’ where audience input can be in tension with progressive musical programing along with the dynamic of response emergent in the energeia of improvisation for performer and listener. L’utopie est nominalement un nulle part qui est aussi, comme nous le dit Thomas More, un “bon” endroit. Bien qu’il existe des notions concurrentes, la description grecque occupe une place importante dans la plupart des récits d’utopie. Les détails de cet idéal sont si précis que la littérature utopique consiste en un catalogue (et une critique) de ces caractéristiques. Cet essai attire l’attention sur le parfum attribué aux « Îles des bienheureux » de Lucien, ainsi que sur la description qu’en (...) fait Nietzsche, sur sa sensibilité à l’odorat et sur l’attention portée par Illich à l’« atmosphère » et au nez. On aborde également le scepticisme envers l’utopie et des parallèles sont établis, d’une part, avec les critiques pragmatiques de l’utopie comme étant intrinsèquement totalitaires, d’autre part, avec la « bonne vie » dans la théorie politique et le défaut programmatique de la fantaisie techno-utopique. It is well-known that as a term, Nietzsche’s Übermensch derives from Lucian of Samosata’s hyperanthropos. I argue that Zarathustra’s teaching of the overman acquires new resonances by reflecting on the context of that origination from Lucian’s Kataplous – literally, “sailing into port” – referring to the soul’s journey, ferried by Charon, guided by Hermes, into the afterlife. The Kataplous he tyrannos, usually translated Downward Journey or The Tyrant, is a Menippean satire telling the tale of the “overman” who is imagined (...) to be superior to others of “lesser” station in this-worldly life and the same tyrant after his (comically unwilling) transport into the underworld. As a reflection on the life and the death of Zarathustra, this essay also explores the politics of kingship for Empedocles as reformer in terms of Hölderlin’s Death of Empedocles and Nietzsche’s unpublished drafts on the same topic. In Thus Spoke Zarathustra, Nietzsche points to a perspective beyond the here and now, beyond the “values” of our all-too-worldly and all-too-human concerns, no matter whether in terms of perceived political/economic advantage, or indeed in the pursuit of more quotidian satisfactions. Nietzsche and Heidegger pose important philosophical questions to science and its technological projects. The resultant contributes to what may be called a continental philosophy of science and the author argues that only such a rigorously critical approach to the question of science permits a genuinely philosophical reflection on science. More than a thoughtful reflection on science, however, the heart of philosophy is also at stake in such reflections. The author defends that if Nietzsche proposes the resources of art to defend (...) us against truth and the deadly insights of tragic knowledge, then Nietzsche's more arresting claim is his equation of science and art, just as Heidegger aligns techne and poiesis. For Nietzsche, science and art draw upon the same creative powers and both science and art are directed to the purpose of life. /// O ponto de partida deste artigo é o reconhecimento de que Friedrich Nietzsche e Martin Heidegger são dois filósofos que colocam questões profundamente relevantes acerca da Ciência e dos seus projectos tecnológicos. Neste sentido, o plano da autora consiste em demonstrar a viabilidade e a importância do modo não-analítico, ou continental, de fazer Filosofia da Ciência, argumentando que uma reflexão genuinamente filosófica acerca da Ciência não se pode dispensar de um confronto com o modo crítico de fazer filosofia representado tanto por Nietzsche como por Heidegger. Para a autora, os pensamentos críticos destes pensadores acerca da Ciência são bem mais do que uma mera reflexão filosófica acerca da Ciência; na verdade, o que aqui está em causa é propriamente saber de que se trata quando a questão é a da própria Filosofia. Assim, e na medida em que Nietzsche propõe os recursos da arte para nos defender contra as invectivas da verdade e as intuições fatais do conhecimento trágico, a autora do artigo defende que o mais interessante na posição nietzscheana tem a ver com o seu modo de equacionar a relação entre Ciência e Arte, tal como Heidegger acabará por alinhar techne e poiesis. O fundo da questão está em que para Nietzsche tanto a Ciência como a Arte recorrem aos mesmos poderes criativos, para além de que a Ciência e a Arte estão orientadas para a defesa do mesmo propósito: a Vida. Avec Platon, la philosophie occidentale a en effet debute sa longue quete d'un modele pour batir la cite. Le modele de Platon, la justice transcendante ou naturelle (to; fuvsei divkaion), fut accueilli a Rome par Ciceron. Cette phase inaugurale de l'histoire de la philosophie politique occidentale est etudiee dans (...) le premier volume de cette etude: Platonisme politique et theorie du droit naturel. Contributions a une archeologie de la culture politique europeenne. Le platonisme dans l'antiquite, Louvain-Paris, Ed. Peeters, 1995. Le present volume etudie la reception chretienne de la doctrine de Platon, du Veme au XVIIeme siecle. Le lecteur rencontrera d'abord Augustin d'Hippone: l'eveque accueille, puis rejette la theorie platonicienne. Durant le Moyen Age latin, les juristes et le theologien Thomas d'Aquin assoient solidement cette doctrine dans la pensee chretienne en s'opposant a l'augustinisme religieux. De la Renaissance au XVIIeme siecle, Marsile Ficin, Jean Bodin, Jean de Serres, Francisco Suarez, Hugo Grotius, Samuel Pufendorf et John Locke retravaillent encore la notion platonico-chretienne de justice: contre le volontarisme, la pensee theocratique, puis la doctrine de Thomas Hobbes au XVIIeme siecle, cette tradition philosophique met la justice naturelle au fondement de la republique. Le volume "Images de Platon et lectures de ses oeuvres" rassemble vingt et une contributions consacrees a diverses relectures qui ont ete faites de l'oeuvre ecrite de Platon entre le IIIe siecle (Diogene Laerce, Plotin) et le XXe sievle (K. Popper). Dans l'introduction, Ada Neschke met en lumiere le cheminement de ces relectures et souligne le fait que les lectures de Platon sont constamment alimentees par des preoccupations propres a ses lecteurs. Dans un premier temps, l'oeuvre de Platon est integree (...) dans une optique essentiellement theologique; apres l'avenement du kantisme, elle s'inscrit dans un cadre de pensee qui se veut critique et philosophique, c'est-a-dire emancipe de l'ancienne metaphysique. Ainsi, l'oeuvre de Platon represente, d'une part, pour les penseurs chretiens une source d'inspiration concernant les sujets les plus divers: la theologie chretienne (Clement d'Alexandrie, Ficin, les Platoniciens de Cambridge), la mytho-theologie neo-platonicienne (Plethon), l'iconographie de la trinite (Francisco di Hollanda), la politique catholique et le calviniste (Jean Bodin, Jean de Serres), le scepticisme face aux debats theologiques (Montaigne). D'autre part, Platon a la valeur d'une autorite pour les penseurs postkantiens, que ce soit pour construire une philosophie de la nature (Schelling), une ethique (Hegel), une epistemologie (les neo-kantiens Cohen et Natorp) ou encore une ontologie (Heidegger). Enfin, Platon sert de reference dans les debats politiques modernes et contemporains, en particulier dans les discussions sur le liberalisme (J. St. Mill) et le totalitarisme (Popper et ses successeurs). De l'antiquite jusqu'a nos jours, Platon reste donc un auteur qui interpelle son lecteur et lui lance meme souvent un defi. (shrink)

N'y aurait-il de pas de différence notable entre les philosophies analytique et continentale? La première serait la bonne philosophie, la seconde une philosophie non rigoureuse, de comptoir. Ce jugement est l'apanage des philosophes analytiques, qui considèrent leurs confères de formation continentale, à l'instar de Jacques Derrida, comme des " astrologues ", des non-philosophes. L'auteur approfondit ici le débat, en identifiant de façon rigoureuse les différences importantes qui divisent les deux philosophies.

Si Nietzsche, se référant à la philosophie morale de Kant, put invoquer ceux « qui promettent sans en avoir les moyens » et dérider le « menteur qui trahit sa parole dans le moment même où il l’a sur les lèvres », un examen de l’éthique de l’assistance de Heidegger souligne, de son côté, que nous nous trouvons toujours déjà dans l’assistance envers les autres, même si ce n’est que de manière négative ou défectueuse. Le XXe siecle a ete caracterise par l'essor de l'hermeneutique philosophique. Il est temps de proposer un bilan de ces elaborations et de projeter les possibles evolutions de l'hermeneutique au XXIe siecle. Le present volume s'attelle a cette tache: il retrace les chemins de l'hermeneutique, de Wilhelm Dilthey a Michel Foucault. Il met en evidence un phenomene de diversification de l'hermeneutique en l'espece de trois courants prioritaires, dont les divergences de vue ont donne lieu a des debats. D'ailleurs, pour etre (...) feconde, l'hermeneutique a venir aura grand interet a conserver la forme du debat. Le present volume reunit les contributions de chercheurs qui representent des domaines varies de la recherche en sciences humaines: la philosophie, l'histoire de la philosophie, la philologie, l'histoire de l'art, l'anthropologie culturelle et la jurisprudence. La premiere partie est consacree au debat autour de l'hermeneutique philosophique; elle reunit les contributions de J. Grondin, R. Celis et J. Greisch d'une part, de H. Ineichen, H. Kramer et O. Scholz d'autre part. Les theses de l'hermeneutique philosophique sont presentees et soumises a un examen critique. Dans la deuxieme partie, on suit les voies sur lesquelles cheminent aujourd'hui les hermeneutiques des sciences humaines interessees a des objets particuliers: les textes abordes par la philologie ou par l'histoire de la philosophie, les images etudiees par l'histoire de l'art, les structures sociales qui sont les objets de l'anthropologie culturelle, ou encore les normes de la societe qui interessent les juristes. Adorno, no less than Heidegger or Nietzsche, had his own critical notions of truth/untruth. But Adorno’s readers are unsettled by the barest hint of anything that might be taken to be antiscience. To protest scientism, yes and to be sure, but to protest “scientific thought,” decidedly not, and the distinction is to be maintained even if Adorno himself challenged it. For Adorno, so-called “scientistic” tendencies are the very “conditions of society and of scientific thought.” And again, Adorno’s readers tend to (...) refuse criticism of this kind. Scientific rationality cannot itself be problematic and E. B. Ashton, Adorno’s translator in the mid-1960s, sought to underscore this with the word “scientivistic.” Rather than science, it is scientism that is to be avoided. So we ask: is Adorno speaking here of scientific rationality or scientistic rationality? How, in general, are we to read Adorno? (shrink)

Nietzsche's use of metaphor has been widely noted but rarely focused to explore specific images in great detail. A Nietzschean Bestiary gathers essays devoted to the most notorious and celebrated beasts in Nietzsche's work. The essays illustrate Nietzsche's ample use of animal imagery, and link it to the dual philosophical purposes of recovering and revivifying human animality, which plays a significant role in his call for de-deifying nature.

Nietzsche's discovery of the "breath" or spirit of music in the words of Greek tragedy was his testament to oral culture in antiquity and it is significant that his theoretical account of the prosody of ancient Greek endures to this day. Drawing little emaphatic resonance from his readers , Nietzsche reprised yet another tradition of poetic song composition, namely the art of the troubadours in order to rearticulate his argument in The Gay Science. I here explore the passion of the (...) 'knightly art', of poetic song and explore in addition Nietzsche's conception of Wissenschaft . The art of poetry was less an antiquarian rhetorical concept than a practical guide for those of us who seek to be "the poets of our lives".Mit der Enteckung des Geistes oder 'Artems' der Musik in den Worten der grichischen Tragödie deutete Nietzsche die orale Kultur in der Antike auf eine neue Weise. Bisher wurden diese Entdeckung und ihre Konsequenzen für Verständnis der modernen Kultur aber kaum beachtet. Die Abhandlung untersuchtd Nietzsches Auffassung der 'gaya scienza' am Beispiel des Troubadours und der mit ihm verbundenen, jedoch verlorengegangenen mündlichen Tradition von poetischer oder liedhafter Komposition. Nietzsches Deutung der Leidenschaft der ritterlichen Gesangskunst wird en einen Zusammenhang mit seiner Auffassung von Wissenschaft gebracht, und diese wird mit der provençalischen scienza sowie der englischen und französischen science verglichten. Nietzsche's creative and fundamental account of chaos in both its cosmic, universal as well as its humane context, recalls the ancient Greek meaning of chaos rather than its modern, disordered, decadent significance. In this generatively primordial sense, chaos corresponds not to the watery nothingness of Semitic myth or modern, scientific entropy but creative, uncountenancedly abundant potency. And in such an archaic sense, Nietzsche's chaos is a word for both nature and art. Nietzsche's creative conception of chaos equates it with the (...) will to power: as the foundational essence of the world "to all eternity." Beginning with the representation of age in extremis in the nature morte or still life, a depiction of aged artifacts and representations of vanitas, artistic representations particularly in painting associate woman and death. Looking at artistic allegories for age and ageing, raising the question of aura for Walter Benjamin along with Ivan Illich and David Hume, this essay reflects on Heidegger on history together with reflections on the ‘death of art’ as well as Arakawa and Gins and Bazon Brock, both (...) as artists ‘at your service,’ as Brock would say, contra death, and including a brief discussion of wabi sabi and kintsugi. The ‘ageing’ of art includes a review of the (ongoing) debate concerning Michelangelo’s forging of the Laocoon as well as ancient views of age together with contemporary philosophic reflections (Simone de Beauvoir and Michel de Certeau). The figure of Baubô in ancient Greek sculpture and cultic context can make it plain, as Nietzsche shows (as Sarah Kofman follows him on this), that laughter and death are connected (along with fertility cults in antiquity). Satire preserves the Greek tradition of laughing at death and the essay closes with Swinburne. (shrink)

A espiritualidade é o cuidado com a vida em sua integralidade. Como define Faustino Teixeira no artigo “Malhas da hospitalidade”, ela é a _capacidade de celebrar a vida em profundidade_, ou seja, a capacidade humana de reconhecer que a vida tem uma dimensão profunda – da qual irradiam amor desinteressado, gratuidade, atenção, cortesia e hospitalidade – e de se alegrar com isso. Diferentemente do que geralmente se pensa, a espiritualidade não se restringe aos templos e espaços religiosos, antes, diz respeito (...) a pessoas e não a almas etéreas. Portanto, perpassa toda a vida cotidiana. Na atualidade, diante dos desafios dos tempos sombrios em que vivemos, tanto na dimensão política como na de saúde pública, a casa se torna um lugar privilegiado para o cultivo da espiritualidade. Neste artigo, buscamos explicitar a dimensão espiritual da comensalidade de acordo com uma análise interpretativa do filme “A Festa de Babette” (1987), dirigido por Gabriel Axel, baseado na obra homônima da escritora dinamarquesa Karen Blixen. Em nossa análise, buscamos ressaltar a compreensão ecumênica do mistério eucarístico que o filme inspira. (shrink)

Many countries have implemented infection control measures directed at carriers of multidrug-resistant organisms. To explore the ethical implications of these measures, we analyzed 227 consultations about multidrug resistance and compared them with the literature on communicable disease in general. We found that control measures aimed at carriers have a range of negative implications. Although moral dilemmas seem similar to those encountered while implementing control measures for other infectious diseases, 4 distinct features stand out for carriage of multidrug-resistant organisms: carriage presents (...) itself as a state of being; carriage has limited relevance for the health of the carrier; carriage has little relevance outside healthcare settings; and antimicrobial resistance is a slowly evolving threat on which individual carriers have limited effect. These features are of ethical relevance because they influence the way we traditionally think about infectious disease control and urge us to pay more attention to the personal experience of the individual carrier. For both continental and analytic styles of philosophy, the thought of Martin Heidegger must be counted as one of the most important influences in contemporary philosophy. In this book, essays by internationally noted scholars, ranging from David B. Allison to Slavoj Zizek, honour the interpretive contributions of William J. Richardson's pathbreaking Heidegger: Through Phenomenology to Thought. The essays move from traditional phenomenology to the idea of essential (another) thinking, the questions of translation and existential expressions of the turn of Heidegger's (...) thought, the intersection of politics and language, the philosophic significance of Jacques Lacan, and several essays on science and technology. All show the influence of Richardson's first study. A valuable emphasis appears in Richardson's interpretation of Heidegger's conception of die Irre, interpreted as Errancy, set in its current locus in a discussion of Heidegger's debacle with the political in his involvement with National Socialism.
